These Terms of Service ("Terms") govern your access to and use of thermstride.com and the related store, content, products, customer support, and services (collectively, the "Services"). The Services are operated by Jormo LTD, trading as ThermStride ("ThermStride", "we", "us", or "our").

By using the Services or placing an order, you agree to these Terms. Nothing in these Terms excludes or limits rights that cannot lawfully be excluded under applicable consumer law.

1. Eligibility and account responsibility

You must be legally capable of entering into a binding contract to place an order. You are responsible for providing accurate, current information and for protecting any account credentials. Notify us promptly if you suspect unauthorised account activity.

2. Product information and availability

We make reasonable efforts to present product descriptions, colours, sizing, photographs, prices, and availability accurately. Screen settings and production tolerances can cause minor differences. We may correct errors, update information, limit quantities, or discontinue products, subject to applicable law.

3. Heated apparel use and safety

Read and follow the product instructions, care label, compatibility information, and safety warnings supplied with your product. Use only compatible power equipment specified for the product. Disconnect and remove the power source before washing or when instructed. Stop using a product that is damaged, unusually hot, wet in a way prohibited by the care instructions, or otherwise appears unsafe.

ThermStride products are consumer apparel and are not medical devices, protective workwear, emergency equipment, or substitutes for weather-appropriate clothing and professional safety guidance. People with medical conditions, reduced heat sensitivity, circulation concerns, implanted devices, pregnancy, or other relevant circumstances should seek appropriate professional advice before using heated apparel.

4. Orders and contract formation

Your checkout submission is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute acceptance. A contract is formed when we accept the order, normally when it is dispatched. We may decline or cancel an order before dispatch for reasons including payment failure, suspected fraud, pricing or inventory error, shipping restriction, or legal requirement. If we cancel a paid order, we will refund the amount charged.

5. Prices, payment, and taxes

Prices and available currencies are shown at checkout. Taxes may be added or included depending on destination and store settings. You authorise our payment providers to charge the selected payment method for the total shown at checkout.

Unless checkout expressly says that duties and import taxes are included or prepaid, the customer is responsible for customs duties, import taxes, brokerage fees, and similar destination charges.

6. Promotions

Discounts, promotional codes, and limited-time offers are subject to their stated conditions, availability, and end dates. Unless stated otherwise, promotions cannot be combined, exchanged for cash, or applied retrospectively.

7. Shipping

Shipping destinations, processing, estimates, tracking, delays, customs, and delivery responsibilities are described in our Shipping Policy, which forms part of these Terms.

8. Returns, exchanges, and refunds

Our voluntary return process is described in our Return & Refund Policy. Mandatory consumer rights, including remedies for faulty or misdescribed goods and applicable cancellation rights, remain unaffected.

Our London registered office is not a return warehouse. Contact support and obtain the correct return destination before sending any product.

9. Acceptable use

You may not use the Services to violate law, infringe rights, transmit malicious code, interfere with security or operation, scrape or harvest data without permission, impersonate another person, submit false information, or engage in fraudulent or abusive conduct. We may restrict access where reasonably necessary to protect the Services, customers, or third parties.

10. Intellectual property

The Services and their content—including the ThermStride name, logos, text, graphics, photographs, design, and software—are owned by or licensed to Jormo LTD and protected by applicable intellectual property laws. You may use the site for personal, non-commercial shopping purposes. No other licence is granted without prior written permission.

11. Reviews and submitted content

If you submit a review, image, feedback, or other content, you confirm that you have the necessary rights and that it is accurate, lawful, and does not violate another person's rights. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display that content in connection with the Services and marketing, subject to applicable privacy law. We may moderate or remove content where permitted by law.

12. Third-party services and links

Our store is hosted by Shopify and may use third-party payment, fulfilment, analytics, advertising, and other services. Third-party links and services are governed by their own terms and policies. We are not responsible for third-party content or services except where applicable law provides otherwise.

13. Disclaimers

We provide the Services with reasonable care and skill. Except for express promises and rights that cannot be excluded by law, the Services are provided on an "as available" basis. We do not guarantee that the website will always be uninterrupted, error-free, or free from harmful components.

14. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of mandatory consumer rights, or any other liability that cannot lawfully be excluded.

Where permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue, opportunity, goodwill, or data arising from business use of the Services. For consumer purchases, we are responsible for losses that are a foreseeable result of our breach or failure to use reasonable care and skill, but not for losses that were not foreseeable.

15. Indemnity for business or unlawful use

To the extent permitted by law, if you use the Services for business purposes or in violation of these Terms, you agree to compensate Jormo LTD for reasonable losses and costs resulting directly from that violation. This section does not reduce mandatory consumer protections.

16. Privacy

Our handling of personal information is described in our Privacy Policy.

17. Changes to the Services or Terms

We may update the Services and these Terms for legal, operational, security, or commercial reasons. Updated Terms apply from the date posted and will not retroactively change an order already accepted unless required by law or agreed with you.

18. Severability and waiver

If a provision is found unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver of that right.

19. Governing law and disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, except that consumers may retain the right to bring a claim in their country of residence and benefit from mandatory local consumer protections.
